Welcome to DataCity. By using our internet services, you agree to the following Terms of Service ("TOS"), which outline the rights and responsibilities of both DataCity and its customers. Failure to comply with these terms may result in suspension or termination of service.
1. Acceptable Use Policy
Customers agree to use DataCity’s internet services responsibly and in compliance with all applicable laws. The following activities are strictly prohibited:
1.1 Illegal or Unauthorized Activities
- Engaging in hacking, unauthorized access, or any attempts to breach network security.
- Using the service for unlawful activities, including but not limited to copyright infringement, fraud, identity theft, and illegal distribution of software, media, or other intellectual property.
- Using DataCity’s network to access or distribute child exploitation materials, engage in human trafficking, or any other criminal activity.
1.2 Spam, Malware, and Network Abuse
- Sending, distributing, or facilitating the transmission of spam (unsolicited bulk email) or any other form of unsolicited communications.
- Deploying viruses, malware, or any harmful software that disrupts or compromises network security or performance.
- Performing network abuse activities such as Denial-of-Service (DoS) attacks, overloading network traffic, or any actions intended to degrade or disrupt DataCity’s service.
1.3 Fair Usage & Traffic Management
- Customers are expected to use DataCity’s service for normal personal, household, or business usage.
- Excessive bandwidth consumption that disrupts network performance may result in speed restrictions, temporary suspensions, or termination of service.
- DataCity reserves the right to take appropriate actions to ensure fair access for all users.
DataCity reserves the right to monitor network activity for security and compliance purposes. Any violations of this policy may result in immediate suspension or termination of service.
2. Payment Terms & Billing Policies
2.1 Invoice Issuance & Payment Due Date
- Invoices are sent 17 days prior to the invoice due date.
- Payment is due on the invoice date.
- Failure to pay on time may result in late fees and service interruptions.
2.2 Accepted Payment Methods
DataCity accepts the following payment methods:
- Credit Card (Visa, MasterCard, American Express)
- Check
- E-Transfer
- EFT (Electronic Funds Transfer)
2.3 Late Payments & Service Suspension
- If an invoice is overdue by 30 days, DataCity reserves the right to suspend service.
- To reactivate a suspended account, a three-month deposit will be required.
- If a customer is late on payments more than three times within a calendar year, DataCity may require a three-month deposit, which will be held for 12 months to ensure payment reliability.
- Late payments may be subject to additional fees at DataCity’s discretion.
2.4 Billing Errors & Disputes
- Customers must report any errors on invoices within 30 days of the invoice date.
- All disputes must be submitted in writing to billing@datacity.ca.
- If a billing error is confirmed, adjustments will be made accordingly.
3. Equipment Ownership & Responsibility
3.1 Equipment Ownership
- All equipment provided by DataCity to facilitate internet service remains the property of DataCity.
- Customers are granted the right to use this equipment as long as their service remains active and in good standing.
3.2 Equipment Maintenance & Liability
- Customers must take reasonable care of DataCity-owned equipment.
- If equipment is lost, stolen, or damaged (excluding manufacturer defects), DataCity reserves the right to charge the customer for replacement or repair.
- The cost of replacement equipment will be determined based on market value and availability.
4. Price Adjustments & Service Cancellations
4.1 Price Adjustments
- DataCity reserves the right to adjust pricing for month-to-month customers at any time without prior notice.
- Changes in pricing for term-contract customers will be communicated according to the terms of the contract.
4.2 Service Cancellation Requirements
- Month-to-month services require 60 days’ written notice for cancellation.
- Written cancellation requests must be sent to support@datacity.ca.
4.3 Equipment Return Policy
- All DataCity-owned equipment must be returned in good working condition to complete a cancellation.
- If equipment is not returned within the required timeframe, DataCity reserves the right to continue billing for service until the equipment is received.
- If equipment is lost or not returned, DataCity will charge the customer the full replacement cost.
5. Liability & Service Guarantees
5.1 Service Availability & Interruptions
- DataCity aims to provide high-quality internet service but does not guarantee uninterrupted service.
- Outages due to factors beyond DataCity’s control, such as weather conditions, third-party service failures, or unforeseen technical issues, are not the responsibility of DataCity.
- DataCity is not liable for any loss of business, revenue, or data due to service disruptions.
5.2 Security & Privacy
- While DataCity employs security measures to protect customer data, customers are responsible for securing their own networks and devices.
- DataCity does not monitor the content of internet traffic except as required by law or to ensure compliance with this TOS.
6. Amendments & Updates to the Terms of Service
- DataCity reserves the right to update these Terms of Service at any time.
- Customers will be notified of significant changes via email or public notice on the DataCity website.
- Continued use of the service after changes have been made constitutes acceptance of the updated terms.
By using DataCity’s internet services, customers acknowledge and agree to abide by these Terms of Service. Failure to comply with these terms may result in service suspension or termination at DataCity’s discretion.
